Because of some significant opposition to the committee’s proposed changes to this instruction, the committee believes that it is appropriate to state its decision and decision-making process about this instruction in a separate report.

The Advisory Committee on Civil Jury Instructions recommends that the Judicial Council, effective January 20, 2017, approve for publication under rules 2.1050 and 10.58 of the California Rules of Court revisions to CACI No. 3103.
