Summary

Summary

The Family and Juvenile Law Advisory Committee recommends revising two family law summons forms, effective January 1, 2027, to implement Assembly Bill 1297 (Stats. 2025, ch. 48). This bill amends Family Code section 2040 regarding automatic temporary restraining orders applicable in dissolution, nullity, and legal separation proceedings. For these proceedings, the bill expands the automatic temporary restraining order related to insurance to prohibit parties from allowing an insurance plan to lapse for nonpayment of premiums or failing to renew insurance. In addition, the committee proposes using plain language throughout the form and making technical changes. The committee recommends similar plain-language and technical revisions on two additional summons forms for consistency across the summons forms used in family law proceedings. Finally, the committee recommends restructuring and reorganizing all four of the summons forms to promote accessibility.
