Summary
Assembly Bill 1071 ((Kalra); Stats. 2025, ch. 721) requires counsel for represented applicants alleging a violation of the Racial Justice Act by a law enforcement officer to serve a copy of the petition on the law enforcement agency that employed the officer. The Family and Juvenile Law Advisory Committee recommends revising two forms to memorialize this requirement and to make clarifying nonsubstantive changes.
Recommendation
The Family and Juvenile Law Advisory Committee recommends that the Judicial Council, effective July 1, 2026, revise Request for Relief Under the Racial Justice Act--Juvenile Adjudication (form JV-720) and The Racial Justice Act in Juvenile Court (form JV-720-INFO) to incorporate the service requirement for counsel of represented applicants mandated by AB 1071 and to improve clarity and readability.
