Assembly Bill 747 (Stats. 2025, ch. 563) and Senate Bill 85 (Stats. 2025, ch. 403) change California law governing service of a summons in civil cases, including substituted service, proof of service, and court-ordered alternative service. To implement these statutory changes, the Family and Juvenile Law Advisory Committee recommends amending one rule of court, adopting one mandatory form, approving two optional forms, and revising eight forms. The proposed changes would update Judicial Council rules and forms used in family law proceedings and proceedings under the Domestic Violence Prevention Act for consistency with the law governing service, as amended by AB 747 and SB 85.

Recommendation
The Family and Juvenile Law Advisory Committee recommends that the Judicial Council, effective January 1, 2027:
1. Amend California Rules of Court, rule 5.72.
2. Adopt Request to Serve Papers in a Different Way (form DV-205).
3. Approve the following forms:
• Proof of Service of Papers in a Different Way (form DV-217); and
• Declaration of Diligence for Substituted Service of Summons (form FL-116).
4. Revise the following forms:
• Order on Request to Continue Court Hearing (form DV-116);
• Order Granting Alternative Service (form DV-117);
• What if the Person I Want Protection From Is Avoiding (Evading) Service? (form DV-205-INFO);
• Proof of Service of Summons (form FL-115);
• Application for Order for Publication or Posting (form FL-980);
• Order for Publication or Posting (form FL-982);
• Proof of Service by Posting (form FL-985); and
• Proof of Service of Summons (form SUR-115).
