Summary
Assembly Bill 495, effective January 1, 2026, gave the superior court the authority to appoint a custodial but unavailable parent together with a person nominated by that parent as joint guardians of the person of the parent’s child. To facilitate the process of petitioning for and appointing joint guardians under the new law, the Probate and Mental Health Advisory Committee recommends amending one rule, adopting one form, approving one form, and revising eight forms, renumbering one of these. The proposal would also update cross-references, simplify language, and make other improvements to the forms.

The Probate and Mental Health Advisory Committee recommends that the Judicial Council, effective January 1, 2027:
Amend California Rules of Court, rule 7.101;
Adopt Confidential Petition for Appointment of Joint Guardians of the Person—Parent Unavailable (form GC-210(JP));
Approve Consent of Proposed Guardian and Consent to Guardianship and Waiver of Notice (form GC-214);
Revise the following forms:
Petition for Appointment of Temporary Guardian of the Person (form GC-110(P));
Petition for Appointment of Guardian of Minor (form GC-210) and retitle it Petition for Appointment of Guardian;
Child Information Attachment to Probate Guardianship Petition (form GC-210(CA));
Petition for Appointment of Guardian of the Person (form GC-210(P));
Consent of Proposed Guardian, Nomination of Guardian, and Consent to Appointment of Guardian and Waiver of Notice (form GC-211) and retitle it Nomination of Guardian;
Petition for Special Immigrant Juvenile Findings (form GC-220) and retitle it Confidential Petition for Special Immigrant Juvenile Findings--Probate Guardianship; and
Order Appointing Guardian or Extending Guardianship of the Person (form GC-240); and
Revise Forms...
