Summary
The Civil and Small Claims Advisory Committee recommends revising two forms to implement Assembly Bill 2917 (Stats. 2024, ch. 539). AB 2917 changed the types of evidence courts consider in determining whether grounds for a gun violence restraining order exist. Additionally, the committee recommends various changes to improve the forms and to address related issues raised during the public comment period for a recent proposal to implement Senate Bill 899 (Stats. 2024, ch. 544).
Recommendation
The Civil and Small Claims Advisory Committee recommends that the Judicial Council, effective January 1, 2027, revise Petition for Gun Violence Restraining Order (form GV-100) and Can a Gun Violence Restraining Order Help Me? (form GV-100-INFO) to implement AB 2917, improve the forms, and respond to feedback from the California Department of Justice.
