Rules and Forms | Probate Conservatorship: Duties of Conservator and Acknowledgment of Receipt (Action Required)

body

Summary

Summary

To conform to changes in conservatorship law and reduce procedural confusion, the Probate and Mental Health Advisory Committee recommends amending one rule of court, adopting one form, and revising one form. The new form provides an updated statement of the duties of a conservator formatted as a plain-language information sheet for the court to distribute to each newly appointed conservator. A conservator would use the revised form to acknowledge receipt of the statement of duties and the Judicial Council’s Handbook for Conservators as required by Probate Code section 1834. The rule amendment clarifies the conservator’s duty to sign and file the acknowledgment of receipt and updates references to the form numbers and titles.

Recommendation

Recommendation

The Probate and Mental Health Advisory Committee recommends that the Judicial Council, effective January 1, 2027:

1.                     Amend California Rules of Court, rule 7.1051 to update references to the new and revised forms;

2.                     Adopt Duties of Conservator--Probate (form GC-346-INFO) for mandatory use as the statement of duties and liabilities of a conservator required by statute; and

3.                     Revise Duties of Conservator and Acknowledgment of Receipt of Handbook for Conservators (form GC-348) for stand-alone use as an acknowledgment of receipt of both form GC-346-INFO and the handbook, retitling it Conservator’s Acknowledgment of Receipt of Information.
